If Gondek was innocent she would provide the Police her passcode
Former Calgary mayor Jyoti Gondek hasn't voluntarily provided police the passcode to her cellphone, which was seized as part of a municipal corruption investigation, court heard Wednesday.
But the lawyer for the ex-mayor said Gondek has an "unqualified" right under the Charter to maintain her silence.
Calgary Police Service lawyer Doug Taylor is applying for an extension to an order allowing police to seize Gondek's phone in March after being granted a search warrant at her residence.
According to an affidavit from lead Det. Matt White which was read out in court by Taylor, Gondek has been linked to a criminal investigation of a municipal campaign contributor. White has been seconded to the RCMP to conduct the investigation.
