The Supreme Court of Canada has annulled a contested election result from last April, stripping Liberal MP for Terrebonne Tatiana Auguste of her seat in the House of Commons. The Supreme Court’s intervention to overturn the April election result now further jeopardizes Prime Minister Mark Carney’s pursuit of a majority government.

Liberal Tatiana Auguste was declared the winner by one vote over Bloc Québécois candidate Nathalie Sinclair-Desgagné in the last general election on April 28.

A month later, the Bloc Québécois challenged the judicial recount for Terrebonne, demanding a do-over of the vote after Elections Canada acknowledged further irregularities involving five more mail-in ballots.

Friday’s Supreme Court decision voids the result, setting up a by-election where the Bloc Québécois currently holds a strong polling advantage.

According to Poliwave, the Bloc Québécois is projected to win the Terrebonne by-election with 44 per cent of the vote, followed by the Liberals with 34 per cent.

The Supreme Court ruling has national implications, as it strips the Liberals of a seat won by a single vote.

The dispute began over a single mail-in ballot that had never been counted due to an error on the envelope’s address, which caused the ballot to be returned to the sender.

On election night, results indicated Auguste won the riding by 35 votes. However, following a standard validation process, the seat briefly flipped to Bloc Québécois candidate Sinclair-Desgagné by 44 votes.

A judicial recount then flipped the riding back to the Liberals, but only by a single vote.

Auguste’s legal team argued that defining a simple clerical error as an election irregularity would lead to a Pandora’s box of future contestations and post-election litigation, especially in closely contested ridings.

In October, a Superior Court judge rejected her request for a new election, describing the incident as “human error” that did not compromise the overall integrity of Canada’s electoral system.

However, the Supreme Court took a different view, and a by-election is now required under federal election law.
